“Online Course” means the delivery by us of an online course pursuant to which you learn course materials remotely and without us directly engaging with you in your learning, either paid or free. 

​“Taught Course” means a course taught by us personally in a studio, workshop, online, outdoor or classroom setting to which you attend in person, and where we directly engage with you in your learning, either paid or free. This includes e.g. 1-1 teaching sessions and group teaching sessions, either in person or online. 

​"Courses" means both Online Courses and Taught Courses, either paid or free. 

​“Services” means the overall provision of Online Courses, Taught Courses and/or the Course Materials together with such other services as agreed from time to time and used or purchased by you through the Website.

“Course Materials” means the Information provided by Infinity Rising Ltd to accompany a Course provided as part of the Services. This can be in any form e.g. in hard copy or electronic form or in 1-1 teaching form, either in-person or online, paid or free. It includes content, structure and approach of any teachings. 

“Confidential Information” means the information provided by one party to the other in written, graphic, recorded, machine-readable or other form concerning the business, clients, suppliers, finances and other areas of the other party’s business or products, including, without limitation, the Course Materials, including the content, structure and teaching approach, but does not include information in the public domain, information required to be disclosed by any court or regulatory authority, or any information already in the possession or control of the disclosing party.

“Fees” means the fees paid by you to Infinity Rising Ltd for the Services. The fee for free courses is £0.00. 

“Intellectual Property Rights” means copyright, rights in or relating to databases, patent rights, designs and registered designs, trademarks, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.

Terms & Conditions for purchased or free Services from Infinity Rising Ltd

1. Introduction 

The Terms & Conditions for purchased or free Services from Infinity Rising Ltd are set out here. The Definitions for words used are set out in the section above titled ‘Definition of words used on this page”.

These Terms & Conditions, together with the other relevant legal information on this page (e.g. our Privacy Policy and Cookies Policy) are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us.  Nothing in this clause or Terms & Conditions shall limit liability for any fraudulent misrepresentation.

Please read these Terms & Conditions carefully before purchasing and/or using any Information from our Services.

2. The Services

2.1. A description of the Services together with the dates on which the Services will be offered and/or begin are available on our Website. We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.

2.2. We reserve the right to vary or withdraw any of the Services described on the Website without notice.

2.3 In purchasing and/or using Services from us you are confirming that such Services will meet your needs. We do not make any guarantee to you that you will obtain a particular result or outcome from your purchase and/or use of any of our Services.

3. Ordering Services via the Website

3.1. In order to purchase any of the Services online you must enter through secure payment pages provided by us. 

3.2. When you place an order for a Service via the Website, you are offering to purchase the Services based on these Terms & Conditions. Infinity Rising Ltd reserves the right to cancel or decline your order or any part of your order at any time until it has been confirmed in accordance with clause 3.4 below. 

3.3. Following receipt by us of your order for Services via the Website we will contact you confirming receipt of your order.

3.4. A legally binding agreement between us and you shall come into existence when we have:

(a)    accepted your offer to purchase Services from us by sending you an email confirming the purchase; and

(b)    received payment of the relevant Fees from you in accordance with clause 5 below, if a Fee is due from you.

3.5. Where your order consists of multiple Services, each individual Service will be treated by us as a separate offer to purchase.  Acceptance of your offer to buy one or more Services will not be considered an acceptance by us of your offer to purchase any other Services which make up your order.

4. Cancellation and Variation

4.1. Subject to clause 4.2 below, where we have accepted / confirmed the Services being purchased by you and formed a legally binding agreement with you in accordance with clause 3.4 above, then you are permitted within 14 working days starting on the day after the date we have concluded our agreement in accordance with clause 3.3, to cancel your purchase of the Services.

4.2. Notwithstanding clause 4.1 there is no other right to cancel or vary your purchase of Services and any other cancellation and/or variation of course dates will be at the entire discretion of Infinity Rising Ltd.

5. Fees

5.1. The Fees for the Services shall be as set out on the Website.

5.2. Unless otherwise specified at the time you purchase the Services the Fees are exclusive of VAT or other local taxes, the cost of some Course Materials and any delivery costs payable in respect of the delivery of Course Material to you. Each of these costs will be set out in the Website prior to your purchase the Services.

5.3. Fees for the Service selected by you on the Website shall be debited from your credit/debit card or PayPal balance at the time of purchase.

5.4. Any fees charged by your credit or debit card provider in connection with your purchase of Services are for your own account and Infinity Rising Ltd shall not be responsible for these.

5.5. You shall be responsible for all costs you incur in connection with our Services, including your attendance at any Taught Courses or your access onto any Online Course.

6. Liability

6.1. Our Services are for general information and educational purposes only. Their purpose is to provide Information that may contribute towards you pursuing your life goals in a healthy manner. 

​6.2 You are acknowledging that you are participating voluntarily in any use of Infinity Rising Ltd's Services, and you alone are solely and personally responsible for your choices, actions, and results. You acknowledge that you take full responsibility for your health, life, and well-being, for all decisions now and in the future, are healthy enough to engage in our Services, and are under the care of, or have access to, a medical practitioner.

6.3. Infinity Rising Ltd waives any liability with regard to your physical, emotional or mental wellbeing during the duration of the Service or at any time after.

6.4. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of medical, therapy or psychiatric advice. 

6.5. Our Services are NOT a substitute for medical advice and treatment, therapy, counseling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment. It is not to be used in place of any form of diagnosis, treatment, or therapy. Our Services should not substitute for medical advice from a qualified healthcare professional, medical or psychological (mental) diagnosis, treatment and care. In using our Services you should not discontinue or modify any medication or therapy presently being taken pursuant to medical advice, without obtaining approval from a healthcare professional. If you have a health problem (physically or mentally), please speak to your doctor or a healthcare professional immediately about your condition. You must take complete responsibility for your own physical/mental health and emotional well-being. It is up to you to independently assess any decisions, actions or inactions you take resulting from using our Services. 

6.6. For some of our Services, for example Taught Courses which are longer duration 1-1 in person teaching sessions, you agree to disclose certain health and medical information and to update this should this change. 

6.7. Our Services are NOT a substitute for advice and/or representation from professionals for legal, financial, tax, personnel, personal, religious, or spiritual counseling. Any decisions you make, and the consequences thereof, are your own. 

6.8. Under no circumstances can you hold Infinity Rising Ltd liable for any actions that you take based on our Services. You agree not to hold Infinity Rising Ltd liable for any direct, indirect or consequential loss, or any cost or damage incurred by you, or by any person or business related or associated with you, as a result of you using the Services provided by Infinity Rising Ltd. 

6.9. Whilst we endeavour to keep our Services up to date and correct we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Services provided by us. Any reliance you place on such information is therefore strictly at your own risk. 

6.10. Through the Services we provide you may be able to link to other websites, companies and suppliers which are not under the control of Infinity Rising Ltd. We have no control over the nature, content and availability of those sites. The inclusion of any such links does not imply a recommendation or endorsement from us on the views expressed within them.

 

​6.11. Every effort is made to keep the Website and associated platforms up and running smoothly for the provision of our Services. However, Infinity Rising Ltd takes no responsibility for, and will not be liable for, the website and associated platforms being unavailable for technical reasons. 

6.12. Except to the extent that they are expressly set out in these Terms & Conditions, no conditions, warranties or other terms shall apply to the Services. Subject to clause 6.14 no implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

Subject to clause 6.14 below, Infinity Rising Ltd´s total liability arising from or in connection with these Terms & Conditions and in relation to anything which we may have done or not done in connection with these Terms & Conditions and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees in connection with the relevant Services in relation to which a dispute has arisen.

​6.14. Nothing in this Agreement shall exclude or limit Infinity Rising Ltd´s liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation or (iii) any other matter which under English law may not be limited or excluded.

 

6.15. No claim may be brought more than six months after the last date on which the Services concerned have finished or ceased to be provided by us.

7. Intellectual Property

7.1. All Intellectual Property Rights in the Services provided are, and remain, the intellectual property of Infinity Rising Ltd or its licensors, whether adapted, written for or customised for you or not. Please note the Trademarks that are in place. More information is in the “Copyright and trademark information” section of this Website.

​7.2. You are not authorised to:

(a) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;

(b) record on video or audio facility, relay by videophone or other means the Online Course or Taught Course given;

(c) use the Course Materials in the provision of any other course or training whether given by us or any third party trainer. This includes the content, structure and teaching approach of any Courses;

(d) remove any copyright or other notice of Infinity Rising Ltd or 'AlwaysChoose' on the Course Materials; and/or

(e) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.

Breach by you of this clause 7.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Services. We also reserve the right to prosecute for any infringement of this clause.

8. Termination

8.1. We shall be entitled to terminate these Terms & Conditions and cease to provide you with any Services with immediate effect in the event that you:

(a) fail to pay when due your Fees;

(b) act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of Infinity Rising Ltd, any employee, teacher or lecturer who provides the Services or any student who participates in any of the Services alongside you;

(c) are intoxicated through alcohol or illegal drugs while learning; and/or

(d) are in breach of these Terms & Conditions.

8.2. On termination clause 6 (liability), 7 (intellectual property rights) and 9 (assignment) shall continue notwithstanding such termination.

9. Assignment

Any Services provided by us under these Terms & Conditions are personal to you and cannot be transferred or assigned to any other person.

We shall be entitled to assign these Terms & Conditions to any other company without prior notice to you.

We may assign, transfer, sub-contract any of our rights or obligations to any third party at our discretion.

10. Entire Agreement

These Terms & Conditions are the entire agreement between the parties and supersede any prior agreements and arrangements, whether written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us.  Nothing in this clause or Terms & Conditions shall limit liability for any fraudulent misrepresentation.

11. Force Majeure

Infinity Rising Ltd shall not be liable to you for any breach of its obligations or termination under these Terms & Conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer or the trainer’s immediate family, Government edict or regulation.

12. Data Protection in relation to Services we provide

12.1. The nature of the Services provided by us means that we will gather, use, disclose, hold and manage (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. This is also set out in our Privacy Policy which can be found on this Webpage in the “Privacy Policy” section. By purchasing the Services you agree to this Use.

12.2. We are committed to safeguarding your Data and we comply with the current data protection legislation including GDPR. Infinity Rising Ltd is registered by the Information Commissioner's Office and has registration number ZA492559. Your Data Controller is Infinity Rising Ltd, who can be contacted at enquiries@alwayschoose.com.

12.3. Infinity Rising Ltd collects certain Data from you when you visit our Website such as aggregate information on the Website pages that you access or visit, including details of operating system, browser version, domain name and IP address, the URL you came from and go to and the parts of the Website you visit. We use Google Analytics as our method of collecting (and analysing) this Data. This does not include your email address.

We collect Data which is specifically volunteered by you, such as email addresses for your chosen subscription purposes, Service purchase, survey responses and registrations. 

When you purchase Services from us you will need to provide certain Data to us such as your email address, contact details, demographic information and specific personal information. We will also collect Data such as User ID, session identifiers and passwords which are relevant solely to the Services you have purchased.

12.4. The Data we collect from you when you visit our Website is used for internal review in order to improve the content and layout of our Website, to customise the content and/or layout of the Website for individual visitors, and to notify visitors about updates to our Website. You accept the inherent security implications of being and transacting online over the internet and will not hold us responsible for any breach of security.

When we request certain types of Data which is considered to be sensitive information, such as health or financial information, this will be performed using a secure approach in order to maintain security.
